Securities Industry Act, 2016 (ACT 929)

Section 73: (1) The Commission may on an application made to the Commission by (a) a public company incorporated under the Companies Act, 1963 (Act 179); or (b) an external company with a place of business in the Republic within the meaning of Chapter V of the Companies Act, 1963 (Act 179) license the company as a mutual fund company. (2) The company referred to in subsection (1) must have been incorporated solely to hold and manage securities or other financial assets. (3) The application shall be in the prescribed form and contain the particulars specified by or under this Act and as directed by the Commission. (4) The Commission shall within ninety days of receipt of the application communicate its decision on the application in writing to the applicant.
