GHANA SHIPERS' COUNCIL DECREE

Introduction

GHANA SHIPPERS’ AUTHORITY ACT, 19741
AN ACT to establish the Ghana Shippers’ Authority and for connected purposes.
 1. Establishment of the Authority 1) There is hereby established a body to be known as the Ghana Shippers’ Authority.
 2) The Council has perpetual succession, a common seal and may sue and be sued in its own name.
 3) The Council may, for the purpose of its functions under this Act, acquire, hold and dispose of movable or immovable property and enter into a contract or any other transaction

Functions of the Authority
1) The Authority shall provide facilities for mutual consultation between shippers, ship owners and the Railway Corporation on matters of interest to shippers.
 2) Without prejudice to subsection (1), the Authority may
 a) represent the views of shippers on the structure of freight rates, availability and adequacy of shipping space, frequency of sailings, port charges, port facilities and any other related matters;
 b) negotiate and enter into agreements with ship owners on matters affecting shippers’
 c) undertake studies and enquiries on problems affecting shippers in the Republic; 
d) subscribe to the membership of, and co-operate with any other body whose objects are in whole or in part similar to those of the Authority; and
e) do any other lawful act that is conducive or incidental to the performance of the foregoing functions. 
3) The Council may, by resolution, delegate to a member or an officer of the Authority any of its functions and the member or officer shall perform the delegated function.
4) The Council is responsible for the implementation of the cargo sharing provisions of the United Nations Convention on the Code of Conduct for Liner Conferences, 1974, and for the purpose of this subsection the Council
a) Shall administer the cargo sharing formula of 40-40-20 prescribed under the Convention;
b) May waive the allocation of cargo on the basis of the 40-40-20 formula
5) The Authority may, with the approval of the Minister responsible for Transport and Communications, levy charges and commissions for a service it renders to shippers, shipping agents and ship owners.
6) The Council may grant exemptions in respect of a charge or a commission.
