Public Health Act, 2012 (Act 851)
Section 102: (1) A person who manufactures, labels, packages, sells or adver-
tises a food in a
manner that is false, misleading, deceptive or misbranded as regards its character, nature, value additives, substance, quality, quantity, composition, merit or safety commits an offence.
(2) For the purposes of subsection (1), food is misbranded
(a) if it is an imitation of, or resembles any other food or food product in a manner likely to be confused with that food or food product under the name of which it is sold and is not plainly and conspicuously labelled so as to indicate its true
character;
(b) if its labelling or advertising is false, deceptive, misleading
or in violation of this Part, the Regulations or Guidelines;
(c) if it is offered for sale under the name of another food;
(d) if false claims are made for it on the label or otherwise;
(e) ifthepackagingcontainingitorthelabelonit,bearsthename
of a fictitious individual or company as the manufacturer orproducer of the product, or it is falsely stated to be the product of a place or country; or
(f) if it purports to be, or is represented as being, for special dietary uses, unless its label bears the prescribed nutritional information concerning its dietary properties
