Regulation 198
(1) A holder of a mining lease may, not later than ninety days before the expiration of the lease, apply to the Commission as set out in Form Forty-Nine of the First Schedule for a reduction or enlargement of the area which is the subject matter of the lease.
(2) The procedures and deadlines for the reduction of a lease shall be in accordance with regulation 38 to 49 with the exception of the expiration date of the lease, which shall not be modified.
(3) Where the reduction affects the whole lease area, the reduction shall be considered as a surrender and the provisions of regulation 158 to 167 shall apply.
(4) In the case of an enlargement, the procedures prescribed in regulation 177 shall be followed strictly.
(5) The validity period and the annual mineral rights fees payable by the holder shall be the same as provided under the original lease before enlargement.
(6) The partial relinquishment of the lease does not entitle the lease holder to a refund or discount of the annual mineral right fees already paid.
(7) The notice of a grant of a reduction or enlargement of a mining lease shall be as set out in Form Fifty of the First Schedule.
Procedure to Follow
Submit Your Application
Once you have filled and gathered all the required documents you will have to submit it at the district office.
It takes 5 days to review the application. The next 5 days is for notification of errors.
Submission To Mineral Titles Department (MTD)
10 days after registration, the district office shall submit the application to MTD.
MTD review the application in 10 days and records it in the priority register
MTD Publishes In The Gazette
15 days after recording, MTD publishes in the gazette, notify chiefs, traditional authorities etc. through the Commission's District Offices.
Application Dossier
Within ten (10) days after publication, District Office shall submit application dossier to MTD for appropriate recommendation to Minister
Minister Takes Decision
Once you have completed these steps you are ready to start your business.
You need to renew your license every three (3) years.
Approval / Rejected
21 days notification to applicant and Fees payable if approved.
Reasons are given if rejected.
Applicable Fees
Within 60 days, applicant pays applicable fees and gives notice of acceptance of the grant to Minister and Commission in writing.
License
Minister on proof of payment of applicable fees, issues licence to applicant within 30 days after the date of acceptance of the grant....
