Dam Safety Regulations, 2016, L.I. 2236

Regulation 20
(1) The Dam Safety Officer may designate a person as an inspector of a dam if that person possesses the qualification specified in the Fifth Schedule.
(2)        The Dam Safety Officer or an inspector designated under subregulation (l) may, inspect a dam registered under these Regulations.
(3)        In furtherance of subregulation (2), the Dam Safety
Officer or an inspector may inquire into the condition of (a) the dam or part of that dam; and
(b) structures appurtenant to the dam.
(4)        The Dam Safety Offcer or an inspector shall give ten working days notice to the owner of the dam or the operator of the dam before entering the premises of the dam to conduct an inspection of the dam.
(5)        Despite subregulation (4), a Dam Safety Officer or an inspector shall have unrestricted access to a dam in the case of an emergency.
(6)        The Dam Safety Officer or the inspector shall, be admitted by the owner of the dam or the operator of the dam into the premises of the dam, after presenting an identification to the owner• of the dam or the operator of the dam.
(7)        The Dam Safety Offcer or the inspector may, for purposes of this regulation,
(a) direct the owner of the dam or the operator of the dam to
(i)        conduct an inspection of the dam or install instruments for monitoring the dam;
(ii)        supply to the Commission, information on a matter that affects the safety of the dam or the protection of human life, animal life, property or natural resources;
(iii)        carry out maintenance work considered by the Commission as necessary for improving the safety of the dam, under the supervision of the Dam Safety Offcer or a person designated by the Dam Safety Officer;
(b)        take samples of water and materials from the dam for purposes of testing or for use as evidence in connection with an offence committed under these Regulations;
(c)        order an investigation into potential defects found with respect to the dam, after conducting a safety evaluation of  the dam;
(d)        record a statement obtained from a witness regarding accidents and dangerous occurrences at the dam and conduct inquiries into those accidents and dangerous occurrences;
(e)        receive complaints regarding any non-compliance with these
Regulations; and
(J) take measures reasonably necessary to ensure an effective inspection of the dam.




(8) Despite any regulation to the contrary and without limiting subregulation (1), the Dam Safety Officer or the inspector may inspect a dam which is owned or operated by
(a)        the Volta River Authority;
(b)        the Ghana Irrigation Development Authority; (c) the Ghana Water Company Limited; and (d) the Bui Power Authority.
(9)        The Dam Safety Officer or an inspector may, by a written notice to the owner of the dam or the operator of the dam, order the owner of the dam or the operator of the dam to cease to operate the dam, where the Dam Safety Officer or the inspector considers that the continued operation of the dam is not safe until the owner of the dam or the operator of the dam has taken appropriate corrective measures.
(10)        An operator or owner of a dam who contravenes subregulation (6) or acts contrary to an order given under subregulation (9) commits an offence and is liable on summary conviction to a fine of not less than two hundred penalty units and not more than seven hundred and fifty penalty units or to a term of imprisonment ofnot less than one year and not more than two years or to both the fine and imprisonment.
