Regulation 38
(1) The Commission shall, by negotiation, settle any dispute between the Commission and the owner of a dam or the operator of a dam.
(2) Where the parties to a dispute are unable to reach a negotiated settlement, the dispute shall be referred to arbitration under the Alternative Dispute Resolution Act, 2010 (Act 798).
